Well thought out question.  I think we can judge a person's works, but not their character.  When we mock we judge their character.  Say we're on a jury.  We can determine a defendant is guilty beyond a reasonable doubt.  We should not call them names as we walk out of the courtroom - "You yellow bellied sodbuster!!"  Hehe.
