Oral Arguments In NYC Same-Sex Marriage Case
Oral arguments are scheduled to take place Tuesday in
a lawsuit seeking to legalize same-sex marriage in New York City. The case,
Hernandez v. Robles, was filed on behalf of five couples, three of whom
have children. "All of them want and need the legal security that comes
with marriage but has been denied to them," Lambda Legal says on its website.
The lawsuit, filed by Lambda Legal in March 2004, argues that denying same-sex
couples marriage licenses violates the state Constitution's guarantees
of equality, liberty and privacy for all New Yorkers. The trial court ruled
in Lambda Legal's favor in February 2005, and New York City then appealed.
On March 31, New York's highest court ruled that the case should be heard
in the mid-level appeals court. Lamba Legal said it would hold a press
conference at the conclusion of today's oral arguments, to discuss the
"substance" of the arguments made in court - and to outline the remaining
phases of the case.
