One of the wild allegations that was previously posted was that everyone born in the USA is personally incorporated by our government and they used as collateral for our national debt and/or bought and sold on wall street.
Wall Street stock tickers are 4 letters. We'd run out after 459 million people. If you're one of the people who really believes we are being bought and sold on wall street, then tell me your stock ticker and I will personally record it as your purchase yourself on wall street. That means you could buy your "freeedom" if you wanted to by buying yourself. But no , that won't happen, because it is not really being done - just another one of the crazy allegations out there intended to misinform.
Are we being used as collateral for debt? Well, if it is done in secret, it could never be proven or disproven. HOWEVER, stop and think about it for a moment....it is a great marketing gimick. What better way to stop the Chinese from considering an attack on America than to get them to view each US life as an asset they would not want to lose? Would it really be a bad idea if it is done? It is not as if anyone in America has to worry about someone from China knocking on our door saying, "I just bought you. Come work in my cotton fields. I own you now." Human ownership was outlawed by our Constitution after the Civil War folks. So no, slavery is not going on in secret, without the slaves knowing about it.
No one has ever produced proof of it and the issue has been tried in courts numerous time, each time with a negative finding that such a thing is happening. There is an accusation floating around the internet that you are being incorporated with your name in ALL CAPS, and that when your name is spelled in ALL CAPS, it refers to you as a corporation instead of you as a person. This accusation seems to replace the need to produce proof, because it suggests that someone has seen the papers and therefore know how it is spelled, when in reality, no one has seen any such papers. But the fact that the people who are pushing this accusation are claiming that your name spelled out in ALL CAPS means something different legally than it does when spelled in normal mixed case would suggest the rumor is more likely to be false than true. Why? Because our courts have consistently held such a thing to be false.
Some people who have believed this rumor have gone into court spelling their name in ALL CAPS and the courts have struck it down as false. Among the court cases wherein the courts have consistently held that spelling your name in all caps does not refer to a different legal entity than you yourself personally are;
US v. Frech (10th Cir unpub 6/16/98) 149 F3d 1192(t).
"Defendants' assertion that the capitalization of their names in court documents constitutes constructive fraud, thereby depriving the district court of jurisdiction and venue, is without any basis in law or fact."US v. Washington (SDNY 1996) 947 F.Supp 87
. "Finally, the defendant contends that the indictment must be dismissed because 'Kurt Washington,' spelled out in capital letters, is a fictitious name used by the Government to tax him improperly as a business, and that the correct spelling and presentation of his name is 'Kurt Washington.' This contention is baseless."Jaeger v. Dubuque County (ND Iowa 1995) 880 F.Supp 640 at 643
. "The court finds Jaeger's arguments concerning capitalization otherwise specious. The court routinely capitalizes the names of all parties before this court in all matters, civil and criminal, without any regard to their corporate or individual status..."Stoecklin v. US (MD Fla unpub 12/8/97).
"Tax evader complained of his name being in a prior order issued by this court and then...makes and incorrect reference to this form of using all capital letters as being proper only in reference to corporate entities. This is an incorrect statement of the law...is illustrative of [his] continued harassing and frivolous behavior."US v. M.L. Lindsay (10th Cir 7/1/99) F3d, 99 USTC para 50648, 84 AFTR2d 5102.
Rippy v. IRS (ND Calif unpub 1/26/99). Davis v. Deddens (SD Ohio unpub 4/18/98). Russell v. US (WD Mich 1997) 969 F.Supp 24 Gdowik v. US (Bankr. SD Fla unpub 7/23/96)
Sadlier v. Payne (D Utah 1997)974 F.Supp 1411.
Braun v. Stotts (D Kan unpub 6/19/97) aff'd (10th Cir unpub 2/4/98).
Vos v. Boyle (WD Mich unpub 4/11/95).
Liebig v. Kelly-Alle (EDNC 1996) 923 F.Supp 778).
US v. J.F. Heard (ND WV 1996) 952 F.Supp 329).
Napier v. Jones (WD Mich unpub 2/10/95).
Wacker v. Crow (10th Cir unpub 7/1/99).
Brown v. Mueller (ED Mich unpub 6/24/97).
Harvard v. Pontesso (6th Cir unpub 8/8/97) 121 F3d 798(t).
State v. Martz (Ohio App unpub 6/9/97).
WOW!!!! That's a long list - and I haven't even included all the cases because some were too ahrd to include , and the source I used (click for source) probably didn't have them all either.
One thing nearly all these court cases appear to have (fron reading the source) is that they are reasonably recent (1995 or later) and all based on people who believed what they read on the internet that their name in ALL CAPS refers to the corporation the USA created on their behalf, and not them personally, and they tried to challenge a case based on that false presumption. Over and over again, the courts have consistently held that your name spelled in ALL CAPS does not refer to you as a corporation rather than individually, and each case has found no evidence of such a thing existing. These people have attempted to allege in court that the government is incorporating them via ALL CAPS as a legal entity, and such a claim has failed every time the courts have examined the evidence.
So the folks at a lot of these web sites are spewing out a lot of legal fiction that simply won't hold up in court. If something sounds too outrageous to be true, assume that it is, don't pass it on.
Shalom,
Joe
