If you click on the link to read the second page of this article at http://www.boston.com/news/world/latinamerica/articles/2005/05/09/vatican_orders_probe_of_mexican_orders_founder?pg=2 you will see that "Ratzinger had shelved the case in 1999 on the grounds that the case would upset the pontiff."  The article doesn't say why Pope Ratzinger has now reopened the case, but imagine Ratzinger being more concerned about upsetting the pontiff than he was about the eight former seminary students who were sexually abused many years ago.
