Judge: Schools Must Remove “Evolution is Theory” Stickers
Thursday, January 13, 2005
By Sam Kastensmidt
In a blatant act of judicial censorship, a federal judge in Georgia has ordered the Cobb County School District and Board of Education to remove textbook stickers designed to advise biology students that “evolution is a theory, not a fact.”
Though nearly all scientists would concur that evolution is nothing more than a “theory” in the debate over the origins of human life, U.S. District Judge Clarence Cooper feared that the stickers might lead students to confuse the word “theory” is a mere “hunch.” In his decision, Judge Cooper argued, “Due to the manner in which the sticker refers to evolution as a theory, the sticker also has the effect of undermining evolution education to the benefit of those Cobb County citizens who would prefer that students maintain their religious beliefs regarding the origin of life.”
Apparently, Cooper would rather force-feed faulty science to younger generations.
Telling the Truth Violates the Establishment Clause?
In his final analysis, Judge Cooper relied upon a misinterpretation of the First Amendment. Citing the so-called separation of church and state, which is never once mentioned in the U.S. Constitution, Cooper argued that the sticker sends “a message that the school board agrees with the beliefs of Christian fundamentalists and creationists.”
“The school board has effectively improperly entangled itself with religion by appearing to take a position,” he concluded. “Therefore, the sticker must be removed from all the textbooks into which it has been placed.”
School Board District Attorney Responds
Linwood Gunn, attorney for the Cobb County School District, told reporters, “Science and religion are related and they are not mutually exclusive. This sticker was an effort to get past the conflict and to teach good science.”
Despite the pleas of more than 2,000 parents, one judge has forced an entire school district to deceive children by teaching evolution as fact — without any competitive theories about the origin of human life.
